الشروط العامة للاستخدام

Article 1 — Purpose

These Terms of Use ("Terms") govern access to and use of the website lesadvisors.com (the "Website"), the SaaS application accessible at app.lesadvisors.com (the "Application") and all associated services (collectively, the "Services"), published and operated by OPAGAN, a French simplified joint-stock company (SASU) with a share capital of 4,000 euros, registered office at 5 Place de la Liberation, 93450 L'Ile-Saint-Denis, France, registered with the Bobigny Trade and Companies Register under SIREN number 918 282 138 (hereinafter "the Publisher" or "OPAGAN").

Access to the Website and the Application implies full and unreserved acceptance of these Terms. If you do not accept these Terms, you must immediately cease all use of the Services.

Article 2 — Definitions

  • Website: the website accessible at lesadvisors.com and its subdomains.
  • Application: the "Les Advisors" SaaS platform accessible at app.lesadvisors.com.
  • Services: all features offered by the Website and the Application.
  • User: any natural person accessing the Website or the Application.
  • Client: any legal entity that has subscribed to the Services.
  • Account: the User's personal space, accessible via login credentials.
  • Content: any information, text, image, data, analysis or result made available through the Services.
  • AI Content: any content generated by the artificial intelligence systems integrated into the Services.
  • Personal Data: any information relating to an identified or identifiable natural person within the meaning of GDPR.

Article 3 — Access to Services

3.1. Website Access. The Website is freely accessible to any User with an internet connection. The Publisher endeavours to keep the Website accessible at all times but does not guarantee continuous availability. Access may be interrupted for maintenance, updates or force majeure.

3.2. Application Access. Access to the Application is reserved for Clients who have subscribed and their authorised Users. Access requires personal and confidential login credentials.

3.3. Technical Requirements. The User must have a modern web browser (Chrome, Firefox, Safari, Edge — latest versions) and a stable internet connection. The Publisher does not guarantee compatibility with outdated browsers.

3.4. Account Creation. Only Users authorised by a Client may create an Account. Account creation is subject to verification of the Client's company email domain.

Article 4 — User Obligations

4.1. The User undertakes to:

  • Provide accurate and up-to-date information during registration
  • Maintain the confidentiality of login credentials
  • Not share credentials with third parties
  • Immediately report any unauthorised use of the Account
  • Use the Services in accordance with their intended purpose and applicable law
  • Not attempt to access data of other users or clients
  • Not use robots, scrapers or automated tools to extract data from the Website or Application

4.2. The User shall not:

  • Use the Services for unlawful, fraudulent or purposes contrary to public order
  • Compromise the security or integrity of the Services
  • Reproduce, modify, distribute or create derivative works from the Services
  • Use the Services to directly compete with the Publisher
  • Resell, sublicense or transfer access to the Services to unauthorised third parties
  • Introduce viruses, malware or any malicious code
  • Intentionally overload the Services infrastructure

Article 5 — Description of Services

5.1. Les Advisors SaaS Platform. The Services include an integrated online software platform (SaaS) for consulting firms, recruitment agencies and transition firms, offering analysis, scoring, data enrichment and AI-generated content tools.

5.2. Modules. The Services include the following modules, depending on the Client's subscription: Opportunity Radar, Advisory CRM, Smart Outreach, Contact Intelligence, Premium Support, Connect, Smart Mail, Deal Intelligence, Talent Radar, Market Insights, RFP Intelligence.

5.3. Artificial Intelligence. The Services integrate artificial intelligence technologies (notably Claude by Anthropic) for content generation, analysis, scoring and data enrichment. The User acknowledges and accepts that:

  • AI Content may contain errors, inaccuracies or incorrect data
  • AI Content does not constitute professional advice
  • The User is solely responsible for validating and using AI Content
  • AI results are provided for informational purposes and do not replace human judgment

5.4. Evolution of Services. The Publisher reserves the right to modify, improve or remove features of the Services at any time, with reasonable notice for substantial changes.

Article 6 — Intellectual Property

6.1. Publisher's Property. All elements of the Website and Application (structure, design, texts, images, logos, icons, software, databases, algorithms, AI models) are the exclusive property of the Publisher or are used under licence. They are protected by French and international intellectual property laws.

6.2. Licence of Use. The Publisher grants the User a personal, non-exclusive, non-transferable, non-assignable and revocable licence to use the Services, limited to the duration of the subscription and the Client's internal professional use.

6.3. Prohibitions. Any reproduction, representation, modification, publication, transmission or distortion, in whole or in part, of any element of the Services, by any means, without prior written authorisation from the Publisher, is strictly prohibited and constitutes infringement under Articles L.335-2 et seq. of the French Intellectual Property Code.

6.4. Trademarks. "Les Advisors", "OPAGAN" and associated logos are registered trademarks. Any reproduction or use without authorisation is prohibited.

6.5. Client Data. The Client retains ownership of its data. The Client grants the Publisher a licence to store, process and use such data for the purpose of providing the Services, improving algorithms and creating aggregated and anonymised statistics.

Article 7 — Liability

7.1. Publisher's Liability. The Publisher endeavours to ensure the proper functioning of the Services. However, the Services are provided "as is". The Publisher does not guarantee:

  • Continuous and uninterrupted availability of the Services
  • The absence of errors, bugs or security vulnerabilities
  • The accuracy, reliability or completeness of AI Content
  • Compatibility of the Services with all systems or configurations

7.2. Limitation of Liability. The Publisher shall not be liable for indirect damages, including loss of profits, data loss, loss of customers, lost revenue or reputational damage. The Publisher's total liability is limited to amounts paid by the Client in the preceding three (3) months.

7.3. Force Majeure. The Publisher shall not be held liable for failure to perform its obligations in cases of force majeure, including but not limited to: natural disasters, pandemics, strikes, acts of terrorism, internet infrastructure failures, third-party provider failures, changes imposed by AI providers.

Article 8 — Hyperlinks

The Website may contain links to third-party websites. The Publisher exercises no control over such websites and disclaims all liability regarding their content, availability or data protection practices.

Article 9 — Hosting

The Website and Application are hosted by:

  • OVH SAS, 2 rue Kellermann, 59100 Roubaix, France
  • Data hosted exclusively in France (OVH France datacenter)
  • Isolated Docker architecture per client for maximum security

Article 10 — Amendment of Terms

The Publisher reserves the right to amend these Terms at any time. Amendments take effect upon publication on the Website. Continued use of the Services after amendment constitutes acceptance of the new Terms. The Publisher will inform Users of substantial amendments by email or notification in the Application.

Article 11 — Governing Law and Jurisdiction

These Terms are governed by French law. Any dispute relating to the interpretation or performance of these Terms shall be submitted to the exclusive jurisdiction of the Bobigny Commercial Court, unless mandatory legal provisions provide otherwise.
